This website is owned and operated by JNE Austrading Pty Ltd, an Australian company operating under the Happy Brick Land brand (“Happy Brick Land”, “we”, “our” or “us”).
These Terms of Service (“Terms”) apply to your access to and use of www.happybrickland.com (the “Site”), including any purchases made through the Site.
By accessing the Site, creating an account or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy and Returns & Refunds Policy. If you do not agree, please do not use the Site.
1. Eligibility and Use of the Site
You must have the legal capacity to enter into a binding agreement in your country or region.
If you are under the applicable legal age, you may only use the Site under the supervision of a parent or legal guardian.
You agree to use the Site only for lawful purposes. You must not:

We make reasonable efforts to ensure that product descriptions, specifications, dimensions, colours, images, compatibility information, availability and prices are accurate.

Unless expressly stated otherwise, display cases, frames, stands and lighting products do not include the building sets, models, figures or collectibles shown in product images.
Third-party names, model numbers and trademarks may be used solely to describe compatibility. LEGO® is a trademark of the LEGO Group, which does not sponsor, authorise or endorse Happy Brick Land unless expressly stated otherwise.
4. Product Safety
Some products may contain small parts, batteries, electrical components or other items that require careful handling.
Customers must follow all safety warnings, installation instructions, age recommendations and product-specific guidance provided with the product or displayed on the relevant product page.
Products containing small parts may present a choking hazard and are not suitable for children under three years of age.
Adult supervision is recommended where products are assembled, installed or used by children.
Customers are responsible for ensuring that products are installed securely and used only for their intended purpose.
5. Orders and Contract Formation
Submitting an order constitutes an offer to purchase the selected products.
An automated order confirmation acknowledges that we have received your order but does not necessarily mean that the order has been finally accepted.
Subject to applicable law, acceptance occurs when:

We otherwise confirm that the order has been accepted and is being fulfilled.
We reserve the right to refuse or cancel an order where reasonably necessary, including when:

If we cancel an order after payment has been received, we will issue a refund to the original payment method for the cancelled amount.
6. Pre-Orders and Customised Products
Products marked as pre-order, made-to-order or customised may have longer preparation times.
Estimated availability and dispatch dates are provided in good faith but may change because of manufacturing, customs, freight or other circumstances outside our reasonable control.
If a material delay occurs, we will make reasonable efforts to notify you and provide available options in accordance with applicable consumer law.
Customised or made-to-order products may not qualify for change-of-mind returns unless they are faulty, damaged, incorrectly supplied or otherwise covered by mandatory consumer rights.
7. Pricing and Currency
Product prices are displayed in the currency selected or detected on the Site.
Currency conversions may be approximate. Your payment provider may apply its own exchange rate, conversion fee or international transaction charge.
We make reasonable efforts to maintain accurate pricing. If an obvious pricing error is identified after an order has been submitted, we may contact you to:

Cancel the affected item and issue a refund.
Promotional prices, discount codes and special offers may be subject to separate conditions, availability periods, usage limits and product exclusions.
Discount codes cannot be exchanged for cash and generally cannot be applied retrospectively unless we agree otherwise.

Payments are processed through Shopify and authorised third-party payment providers.
By submitting payment information, you confirm that:

We do not directly store complete payment-card information. Payment providers process payment data according to their own terms and privacy policies.
Orders may be delayed or cancelled if payment cannot be verified or authorised.
9. Shipping and Delivery
Processing times, delivery estimates, available destinations, tracking information and shipping restrictions are set out in our Shipping Policy.
Delivery dates are estimates unless expressly stated otherwise.
Customers are responsible for providing a complete and accurate delivery address. Additional costs may apply if a parcel is returned, redirected or requires redelivery because of an incorrect address, refusal of delivery or failure to collect the parcel.
Some orders may be dispatched in multiple parcels or from different fulfilment warehouses.
Risk of loss and legal title will transfer in accordance with the mandatory laws applicable to the transaction. Nothing in these Terms transfers risk earlier than permitted by applicable consumer law.
10. Customs Duties, Taxes and Import Requirements
International orders may be subject to customs duties, VAT, GST, brokerage fees or other import charges imposed by the destination country.
Where taxes or duties are collected at checkout, the applicable amount will be displayed before payment.
Unless otherwise stated at checkout, import duties, taxes and customs clearance charges are the responsibility of the recipient.
Customers are responsible for confirming that the ordered products may be lawfully imported into their destination country.
If a parcel is refused, abandoned or returned because the recipient does not pay applicable import charges, reasonable return and handling costs may be deducted from any refund where permitted by law.
11. Returns, Refunds and Warranties
Returns, refunds, faulty-product claims and change-of-mind requests are handled according to our Returns & Refunds Policy and any mandatory consumer laws applicable to the customer.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, warranty, right or remedy that cannot legally be excluded or limited.
If a product is faulty, damaged, incorrectly supplied or materially different from its description, please contact us and provide:

Available remedies may include repair, replacement, refund or another remedy required by applicable law.
12. Cancellations and Order Changes
Please contact us as soon as possible if you need to cancel or modify an order.
We cannot guarantee changes or cancellations after an order has entered processing, production or dispatch.
Customised and made-to-order products may not be cancelled after production has commenced unless required by applicable law.
If an address modification results in additional delivery costs, the customer may be responsible for those reasonable costs where permitted by law.
13. Intellectual Property
All content on the Site, including text, graphics, photographs, videos, logos, page layouts, downloadable materials, product imagery and original designs, is owned by or licensed to JNE Austrading Pty Ltd and is protected by applicable intellectual property laws.
You may access and use Site content for personal, non-commercial shopping purposes.
Without our prior written permission, you must not:

If you submit a review, photograph, video, comment or other content, you retain ownership of your original content.
You grant JNE Austrading Pty Ltd a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt and publish that content for operating, improving and promoting Happy Brick Land, subject to applicable privacy and consumer laws.
You confirm that submitted content:

Is accurate and based on your genuine experience

Does not infringe another person’s rights

Is not unlawful, abusive, misleading or defamatory

Does not contain malicious code or unauthorised personal information
We may moderate or remove content that violates these Terms, but we are not required to publish every submission.

Our online store is hosted by Shopify Inc. We may also use third-party providers for payments, fraud prevention, analytics, communications, reviews, shipping and other business functions.
Third-party services are governed by their own terms and privacy policies.
The Site may contain links to third-party websites. These links are provided for convenience and do not necessarily indicate endorsement.
We are not responsible for third-party content, security, availability or privacy practices, except to the extent responsibility cannot legally be excluded.

Where liability may lawfully be limited, our aggregate liability relating to an order will not exceed the amount paid for the product giving rise to the claim.
This limitation does not reduce any mandatory remedy available to the customer under applicable consumer law.
19. Events Outside Our Control
We are not responsible for delay or failure caused by events outside our reasonable control, including:

Labour disputes

Epidemics or public-health emergencies

Carrier or transport-network disruption

This section does not exclude any right or remedy that cannot legally be excluded.
20. International Customers and Local Laws
The Site is operated from Australia and serves customers in multiple countries and regions.
Customers may have mandatory rights under the laws of the country or region in which they reside. Nothing in these Terms is intended to exclude, restrict or override those rights where they cannot legally be excluded.
Customers are responsible for complying with applicable import, customs and product-use requirements in their destination country.
If a provision of these Terms conflicts with a mandatory local consumer law, the mandatory law will apply to the extent of the conflict.

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply.
Our failure to enforce a provision on one occasion does not waive our right to enforce it later.

These Terms are governed by the laws of Victoria, Australia, without excluding any mandatory consumer protection available to customers in their country or region.
Subject to any mandatory right to bring a claim elsewhere, the courts of Victoria, Australia will have non-exclusive jurisdiction over disputes relating to these Terms.
Before commencing formal proceedings, you agree to contact us and provide a reasonable opportunity to resolve the concern. This does not restrict your right to contact a consumer protection authority, payment provider or court where permitted by law.
